How These Terms Apply
These Job Marketplace Terms form part of the Yuno Terms and Conditions. They apply in addition to the Privacy Policy, Community Guidelines, and Refund and Cancellation Policy. If there is a conflict about a job feature, these Job Marketplace Terms apply to that feature, subject to rights and obligations that cannot lawfully be excluded.
In these terms, a Job Poster is a person, business, or organisation that publishes or manages a job or shift; an Applicant is a person who applies for a job; a Worker is an Applicant who accepts an offer or performs work; and a Job Listing includes a long-term role, Casual shift, urgent hiring placement, imported listing, or other work opportunity displayed through Yuno.
Yuno's Role
Yuno provides technology for publishing and discovering Job Listings, submitting and managing applications, communicating, moderating content, facilitating selected payments, recording shift information, and handling related support. Unless Yuno expressly agrees otherwise in writing for a specific service, Yuno is not the Job Poster, employer, host employer, recruiter making the hiring decision, migration adviser, payroll provider, insurer, workplace supervisor, or provider of the work itself.
Yuno does not direct or control the manner in which work is performed and does not make the final decision to employ, engage, roster, dismiss, or discipline a Worker. Any employment, contractor, or other work relationship is between the Job Poster and the Applicant or Worker. The parties are responsible for determining the correct legal character of that relationship. Calling a person a contractor, asking them to provide an ABN, or using Yuno does not determine their legal status.
Nothing in these terms changes any legal character, duty, or regulatory status that applies because of the actual arrangement or the way a service is operated. Yuno may change, restrict, or suspend a job feature where reasonably necessary to obtain advice, meet regulatory requirements, protect users, or reduce legal, safety, payment, or fraud risk.
Authority and Job Poster Warranties
By creating or managing a Job Listing, you represent and warrant that you are legally able and authorised to act for the named business, use its name, address, logo, trade marks, and other materials, recruit for the role, make offers, and meet all obligations arising from the listing and any resulting work.
You must provide accurate, current, complete, and non-misleading information about the business, role, duties, employment type, pay, benefits, hours, location, start date, qualifications, licences, risks, application deadline, and material conditions. You must promptly correct or close a listing that becomes inaccurate, unavailable, filled, unsafe, or unlawful.
Yuno may request evidence of identity, authority, business details, work location, insurance, licences, qualifications, payroll readiness, or legal compliance. Yuno may refuse, delay, restrict, pause, or remove a listing or job feature where information is incomplete, cannot reasonably be verified, creates risk, or appears to breach these terms or law.
Employment and Workplace Obligations
The Job Poster is solely responsible for the recruitment decision and for complying with all laws that apply to an Applicant or Worker. This includes correctly identifying the employer and the worker's status, checking any right to work and required qualifications, giving required information and employment documents, and complying with applicable awards, enterprise agreements, the National Employment Standards, contracts, policies, and workplace laws.
The Job Poster is responsible for correctly calculating and paying all wages and entitlements, including minimum rates, classifications, Casual loading, penalty rates, overtime, allowances, minimum engagements, paid work time, leave, superannuation, tax withholding, payroll reporting, final pay, and any other amount required by law. The Job Poster must provide lawful payslips and maintain employment, wage, time, tax, and superannuation records for the required periods.
The Job Poster is also responsible for workplace health and safety, inductions, supervision, equipment, breaks, facilities, workers compensation insurance, public liability insurance where appropriate, incident reporting, child employment requirements, anti-discrimination duties, harassment prevention, reasonable adjustments, and any industry, occupation, venue, or location-specific requirement.
An estimate, wage prompt, category, classification, reminder, payment calculation, or other information supplied by Yuno is a platform aid only. It may be based on limited information and may not account for every award, agreement, classification level, age, apprenticeship, traineeship, qualification, duty, allowance, break, overtime rule, public holiday, local variation, or change in law. The Job Poster must independently verify and pay all applicable entitlements and must increase a displayed or agreed amount where required.
Fair and Lawful Recruitment
Job Posters must recruit lawfully and fairly. Job Listings and hiring decisions must not unlawfully discriminate or indicate an intention to discriminate on the basis of sex, pregnancy, marital or relationship status, race, colour, descent, national or ethnic origin, immigrant status, disability, age, religion, sexual orientation, gender identity, family or carer responsibilities, or any other protected characteristic.
You must not advertise or offer a fake, misleading, unlawful, unsafe, exploitative, or unavailable role; demand unlawful unpaid work; disguise employment as contracting; misstate pay or conditions; charge an Applicant an unlawful recruitment, placement, equipment, visa, training, or security fee; request unnecessary sensitive information; or use recruitment to facilitate fraud, trafficking, sexual services, illegal activity, or identity theft.
Applicants and Workers
Applicants must provide information they reasonably believe is accurate and must not submit a false identity, fabricated qualifications, altered licences, misleading work history, malicious files, or another person's information without authority. Applicants are responsible for deciding whether a role is suitable and for making reasonable checks about the Job Poster, workplace, duties, pay, conditions, travel, safety, and required qualifications before accepting work.
An Applicant or Worker must have the legal right, minimum age, capacity, licences, qualifications, and approvals required for the relevant work. They must comply with lawful workplace directions and safety requirements and must not misuse employer, customer, workplace, or other confidential information.
Yuno does not guarantee the identity, authority, solvency, qualifications, conduct, reliability, suitability, background, work rights, or accuracy of a Job Poster, Applicant, or Worker unless Yuno expressly states that a particular check has been completed. A completed check is limited to the matter and time stated and is not a general endorsement.
Applications, Resumes, and Hiring Decisions
When an Applicant submits an application, Yuno may make the application, profile details, resume, cover note, proposed rate, and related information available to the Job Poster and authorised reviewers for recruitment, moderation, safety, support, dispute, and compliance purposes. Further information is set out in the Privacy Policy.
Submitting an application does not create employment, guarantee that it will be reviewed, or guarantee an interview, offer, shift, or response. A Job Poster may close, pause, reject, or fill a role, subject to law. Yuno may notify Applicants about application events but is not responsible for a Job Poster's final decision or failure to respond.
Job Posters must use Applicant information only for legitimate recruitment, hiring, employment administration, safety, legal compliance, and directly related purposes. They must protect it, restrict access, not sell it, not use it for unrelated marketing, and delete or de-identify it when no longer lawfully required. A Job Poster remains responsible for copies downloaded or retained outside Yuno.
Long-Term and Paid Job Listings
Yuno may charge a one-time fee to publish a long-term Job Listing for the period and placement tier shown before purchase. A Featured listing may receive a badge and priority in relevant areas of Yuno, but placement varies with location, relevance, safety, moderation, product design, user settings, and available inventory.
Payment does not guarantee impressions, ranking in every view, applications, interviews, suitable candidates, or a successful hire. Unless expressly stated otherwise, a listing does not automatically renew. Prices, duration, taxes, and inclusions shown and accepted at purchase apply to that purchase. Yuno may change future prices or tiers without changing a completed purchase.
A listing period generally starts when payment succeeds and the listing becomes publishable. Review, verification, legal, safety, or payment checks may delay or prevent publication. Refunds and credits are governed by these terms and the Refund and Cancellation Policy.
Urgent Hiring and Promotional Placement
Urgent hiring or similar paid promotion may highlight a listing and, where enabled, notify potentially relevant users within a stated area for a stated period. Location, eligibility, device permissions, notification preferences, delivery systems, moderation, and other factors may reduce the number of recipients or prevent delivery to a particular person.
Paid promotion does not guarantee notification delivery, views, applications, acceptance, attendance, or hiring. Promotion ends at the earlier of the purchased expiry time or the listing being closed, filled, suspended, removed, or otherwise becoming unavailable. Any refund or credit is subject to the Refund and Cancellation Policy and non-excludable law.
Casual Shift Offers and Acceptance
A Job Poster's invitation or offer and a Worker's acceptance may create a direct commitment between those parties for the stated shift, subject to applicable employment law and any required employment documents. Yuno is not a party to the employment relationship merely because it records the offer or acceptance, communicates status, or facilitates a payment.
Job Posters must ensure the final offer accurately states the employer, work, location, start time, expected duration, pay rate, and material conditions. A Job Poster must not use a Yuno flow to avoid an obligation to provide a written contract, Fair Work Information Statement, Casual Employment Information Statement, roster, policy, or other document required by law.
Casual Shift Payments and Platform Fees
For supported Casual shifts, Yuno may attempt to authorise the Job Poster's selected payment method before the shift, capture an amount after recorded hours are confirmed or resolved, deduct Yuno's disclosed platform fee, and remit the recorded work payment to the Worker on the Job Poster's behalf. The applicable fee rate, basis, currency, taxes, and estimated total are shown or confirmed in the relevant flow and may be locked for that shift.
Unless clearly stated otherwise, Yuno's platform fee is charged to the Job Poster in addition to the recorded Worker payment and is not deducted from the Worker's recorded gross pay. GST is included in a Yuno fee only where Yuno is registered or required to charge GST and the transaction information states that GST applies. A payment provider may apply its own requirements, timing, reserves, verification, failure handling, or restrictions.
A Yuno payment or remittance record is not a payslip, payroll service, tax calculation, Single Touch Payroll report, superannuation contribution, employment contract, or determination of legal entitlements. The Job Poster remains responsible for lawful payroll, withholding, reporting, payslips, superannuation, and any adjustment required so that the Worker receives all entitlements. A Job Poster must not use Yuno's remittance feature where doing so would prevent the Job Poster from meeting those obligations.
Yuno does not guarantee that an authorisation, capture, refund, or payout will succeed or arrive by a particular time. Yuno may retry, delay, withhold, cancel, reverse, or require another payment method where reasonably necessary because of insufficient funds, expiry, fraud, sanctions, disputes, chargebacks, provider requirements, legal obligations, or risk. The Job Poster remains liable for wages, entitlements, Yuno fees, chargebacks, reversals, and other lawful amounts even if a card or platform payment fails.
Hours, Overtime, Cancellations, and No-Shows
The parties must provide accurate shift times and promptly review any proposed adjustment. A recorded or agreed end time is evidence used for platform settlement but does not remove any right to correct underpayment or any obligation to pay all time legally treated as work. Additional time may require an additional authorisation or charge.
Yuno may provide workflows for Worker cancellation, employer cancellation, no-show reports, overtime review, evidence requests, and time disputes. The time limits, statuses, and consequences displayed in the relevant workflow form part of the transaction rules for that shift, but Yuno may extend or adjust a procedural deadline where reasonably necessary for fairness, safety, provider requirements, technical failure, or legal compliance.
Job Posters and Workers must act honestly, preserve relevant records, and submit genuine evidence. Yuno may make an administrative platform decision about payment processing, account action, or feature access based on available information. Yuno does not act as a court or tribunal and cannot finally determine statutory employment rights.
Cancellations, Refunds, Chargebacks, and Recovery
Yuno may cancel or pause a listing, offer, shift, payment, promotion, or payout where reasonably necessary to address safety, legality, fraud, misleading information, payment failure, policy breach, regulatory risk, or a material dispute. Refund and credit eligibility is described in the Refund and Cancellation Policy and is always subject to non-excludable law.
Users must contact Yuno before initiating a chargeback where it is reasonable to do so and must not submit a false or abusive payment dispute. Yuno may provide relevant listing, acceptance, time, attendance, communication, refund, and policy records to a payment provider or financial institution. Yuno may recover from the responsible Job Poster any Worker payment, refund, chargeback, fee, tax adjustment, provider cost, or other amount that Yuno pays or incurs on the Job Poster's behalf, to the extent permitted by law.
Safety and Offline Work
Yuno is not an emergency, security, transport, medical, workplace inspection, or on-site supervision service. Job Posters must provide a safe workplace and Workers should take reasonable personal safety precautions, confirm the workplace and contact person, tell someone where they are going where appropriate, and leave or seek help if they face immediate danger.
Reports of threats, violence, harassment, exploitation, unsafe work, wage concerns, fraud, or other serious misconduct may result in immediate restrictions and may be preserved or referred to the relevant authority where required or reasonably necessary.
Imported and Third-Party Listings
Some Job Listings may be imported, linked, or summarised from a third-party source. The source may control the original listing, application method, expiry, and recruitment process. Yuno may not have verified imported information and does not guarantee that it remains current. Users should review the source listing and applicable third-party terms before applying. Rights holders and authorised businesses may contact Yuno to request correction or removal.
Moderation and Enforcement
Yuno may review listings, applications, accounts, payment records, shift records, reviews, messages reported to us, and supporting evidence to operate the service, enforce policies, investigate disputes, protect users, and comply with law. Yuno may use automated systems and human review.
Yuno may reject, edit for formatting, label, limit distribution of, pause, close, remove, or preserve a Job Listing; restrict applications or communication; cancel an offer or promotion; delay or suspend a payment or payout; require verification; or suspend or terminate an account. Where reasonably practicable, Yuno will consider the seriousness, available evidence, user safety, payment risk, legal requirements, and whether a less restrictive measure is appropriate.
Indemnity
To the maximum extent permitted by law, a Job Poster indemnifies FreeTimes App Pty Ltd and its officers, employees, and contractors against third-party claims, regulatory demands, liabilities, penalties, losses, and reasonable professional costs arising from or connected with the Job Poster's Job Listing, recruitment decision, workplace, employment or engagement of a Worker, breach of these terms, infringement of rights, unlawful discrimination, safety failure, unpaid or underpaid entitlements, tax, superannuation, workers compensation, payroll, migration, or other legal obligation, except to the extent caused by Yuno's unlawful act, negligence, fraud, or wilful misconduct.
An Applicant or Worker indemnifies those parties against third-party claims and reasonable losses arising from that user's fraud, deliberate misrepresentation, unlawful conduct, malicious files, infringement of another person's rights, or material breach of these terms, except to the extent caused by Yuno or the Job Poster.
Disclaimers and Limitation of Liability
Nothing in these terms excludes, restricts, or modifies a consumer guarantee, employment right, privacy right, or other right or remedy that cannot lawfully be excluded. Subject to those rights, Yuno provides user-generated and third-party Job Listings without guaranteeing accuracy, availability, suitability, safety, identity, payment, performance, or outcome.
To the maximum extent permitted by law, Yuno is not liable for indirect, incidental, special, exemplary, or consequential loss, loss of opportunity, loss of profit, loss of business, reputational loss, or loss caused by the acts or omissions of a Job Poster, Applicant, Worker, workplace, payment provider, or other third party.
Where Yuno is liable for a job-related service and liability can lawfully be limited, Yuno's aggregate liability is limited, at Yuno's option where permitted, to resupplying the affected platform service, paying the reasonable cost of resupply, or the greater of AUD 100 and the Yuno fees paid by the claimant for the affected job-related service in the 12 months before the event giving rise to the claim.
Changes and Survival
Yuno may update these terms as job features, prices, laws, payment arrangements, or risks change. If a change is material, Yuno will take reasonable steps to notify affected users. Terms accepted for a completed purchase or confirmed shift continue to apply to that transaction unless law requires otherwise.
Payment, recovery, privacy, evidence, intellectual property, indemnity, limitation of liability, dispute, and other provisions intended by their nature to continue will survive closure of a listing, completion or cancellation of a shift, and suspension or deletion of an account.
